False Information and Defamation Policy

1. Introduction

1.1 Career Calling International Pty Ltd (ABN 53 162 651 238, ACN/ARBN 162 651 238), trading as CAQA Edu ("we", "us", "our"), is dedicated to maintaining a transparent, respectful and mutually beneficial relationship with all clients and stakeholders.

1.2 This policy outlines our approach to false information and defamatory material concerning CAQA Edu or the Career Calling International group — including our procedure for receiving and resolving concerns, our process for correcting or removing inaccurate material, and the circumstances in which we may take legal action against individuals or entities who spread false information or engage in defamatory conduct without first giving us an opportunity to address their concerns.

2. Raise it with us first — communication and issue resolution

2.1 Initial communication. Clients and stakeholders are encouraged to communicate any concerns, issues or dissatisfaction directly to us before discussing them in a public forum or with third parties.

2.2 How to contact us. Concerns should be sent to info@caqa.com.au, or by mail to 2/10 Lawn Court, Craigieburn VIC 3064, Australia, or by phone on 1800 266 160. Please include detailed information about your concern, including any interactions with our representatives, so we can investigate thoroughly.

2.3 Resolution opportunity — 14 days. We are committed to investigating and resolving concerns, and we ask for a minimum of 14 days to address them before matters are escalated or discussed externally. This timeframe allows us to engage the relevant contractors, in-house developers, writers and subject-matter experts, collaborate with our compliance and legal teams, conduct a comprehensive investigation, and prepare and deliver a considered response.

3. Reporting false or defamatory material

3.1 Anyone — whether or not a client — may report material they believe contains false information about us, or that they believe is defamatory (of us or of themselves in connection with our services), whether it appears on this website (https://caqa-edu-preview.netlify.app), on our other channels, or elsewhere.

3.2 Reports should be sent to info@caqa.com.au and include: where the material appears (URL or description); what is said to be false or defamatory, and why; any evidence supporting the correct position; and the outcome sought (correction, clarification, removal, right of reply).

4. Review, correction and removal procedure

4.1 Acknowledgement. We will acknowledge reports within 2 business days, consistent with our Complaints & Feedback Policy.

4.2 Review. We will review the material against the available evidence, consulting relevant staff, subject-matter experts and, where appropriate, our compliance and legal advisers.

4.3 Action. Where material published by us is found to be inaccurate or misleading, we will promptly correct, clarify or remove it, and — where appropriate — publish a correction notice or offer the affected person a right of reply. This reflects the concerns-notice and offer-to-make-amends framework of Australia's uniform defamation law, including the Defamation Act 2005 (Vic).

4.4 Outcome. We will inform the person who raised the concern of the outcome, generally within 14 days of acknowledgement.

5. False information and defamation directed at us

5.1 Spreading false information, engaging in defamatory activities, or making unfounded allegations against CAQA Edu or Career Calling International without allowing us the opportunity to address the concerns is a serious violation of this policy.

5.2 Legal recourse. We reserve the right to take legal action against any individual or entity that spreads false information, engages in defamatory conduct, or undermines our reputation in the industry without first allowing us the opportunity to resolve their concerns. Legal action is a last resort: we will always prefer direct communication, correction and amicable resolution, and where practicable we will issue a concerns notice under the applicable defamation legislation before commencing proceedings.

5.3 Nothing in this policy prevents anyone from making genuine complaints to a regulator, exercising legal rights, or engaging in honest opinion or other conduct protected by law.

6. Legal framework

We adhere to applicable Australian legislation, including but not limited to the Defamation Act 2005 (Vic) and its uniform counterparts in other States and Territories, the Competition and Consumer Act 2010 (Cth) (including the Australian Consumer Law's prohibitions on misleading and deceptive conduct), the Corporations Act 2001 (Cth), the Civil Dispute Resolution Act 2011 (Cth), applicable Uniform Civil Procedure Rules, the Fair Work Act 2009 (Cth) and the Privacy Act 1988 (Cth), in addressing claims and protecting our reputation diligently and lawfully. This policy is governed by the laws of Victoria, Australia.

7. Conclusion

CAQA Edu values open communication, transparency and the resolution of issues in a cooperative and amicable manner. We encourage all clients and stakeholders to communicate directly with us about any concerns before discussing them externally, and we commit in return to investigating honestly, correcting our own errors promptly, and treating everyone who raises a concern with respect and without detriment.
